Terms of Service

These terms ("Terms") govern your use of wishfully.co.uk and the Wishfully web and mobile apps (together, the "Service"), provided by Wishfully ("we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 13 years old to create a Wishfully account. If you are under 18, you confirm you have your parent or guardian's permission to use the Service.

2. Your account

  • You're responsible for keeping your login details secure and confidential.
  • You're responsible for all activity that happens under your account.
  • You must provide accurate information when creating your account and keep it up to date.
  • Let us know immediately at support@wishfully.co.uk if you suspect unauthorised use of your account.

3. Using Wishfully

Wishfully lets you create wishlists, share them with groups you invite, coordinate gift purchases, organise events, and collect RSVPs. You agree to use the Service only for its intended purpose, and not to:

  • Post or share unlawful, abusive, harassing, defamatory or infringing content.
  • Impersonate any person or misrepresent your affiliation with anyone.
  • Attempt to gain unauthorised access to other users' accounts or data.
  • Use the Service to send spam, scrape data at scale, or interfere with its normal operation.
  • Use the Service for any commercial purpose we haven't authorised.

We may suspend or terminate accounts that breach these Terms, at our reasonable discretion, with notice where practical.

4. Your content

You retain ownership of the content you create on Wishfully (wishlists, items, messages, photos, event details, etc.). By posting content, you grant us a limited licence to host, store, display and transmit it as necessary to operate and provide the Service to you and the people you choose to share it with. You're responsible for making sure you have the rights to share anything you post (for example, product images or links).

5. Gifting features & third-party retailers

Wishfully helps you coordinate gift ideas and claims between friends and family, and lets you link to products on third-party retailer websites. We do not sell products, process payments for gifts, or guarantee the availability, price, delivery or quality of any product you link to or purchase elsewhere. Any purchase you make from a linked retailer is solely between you and that retailer, subject to their own terms.

"Claiming" or marking an item as purchased is a courtesy feature to help coordinate gifting within your group — it does not create any binding obligation between users, and we are not responsible for disputes between users about gifts.

6. Groups, events and shared content

When you join a group or event, other members may be able to see content you share within that group or event (e.g. shared wishlists, chat messages, RSVP responses). You're responsible for the content you share and who you invite. Group/event organisers are responsible for managing membership and access to content they create.

7. Privacy

Our Privacy Policy explains how we collect, use and protect your personal data, and forms part of these Terms.

8. Service availability

We aim to keep the Service available and reliable, but we don't guarantee uninterrupted access. We may modify, suspend or discontinue any part of the Service at any time, including for maintenance, security or legal reasons.

9. Intellectual property

The Wishfully name, logo, and the Service itself (excluding your content) are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify or create derivative works of the Service without our written permission.

10. Third-party links and services

The Service may link to or integrate with third-party websites and services (e.g. retailer product pages, maps, sign-in providers). We're not responsible for the content, policies or practices of any third party, and your use of them is subject to their own terms.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. We don't warrant that the Service will be error-free, secure, or available at all times.

12. Limitation of liability

To the extent permitted by law, Wishfully will not be liable for any indirect, incidental or consequential loss arising from your use of the Service, including loss of data, or disputes over gifts between users or with third-party retailers. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, for death or personal injury caused by negligence, or fraud).

13. Ending your use of the Service

You can stop using the Service at any time and request deletion of your account via Settings → Danger zone, or by emailing privacy@wishfully.co.uk — see our Privacy Policy for how deletion requests are handled. We may suspend or terminate your access if you breach these Terms.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you via the Service or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
